AN ACT

 

amending section 8-263, Arizona Revised Statutes; relating to the juvenile court.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 8-263, Arizona Revised Statutes, is amended to read:

START_STATUTE8-263.  Order for counseling; antigang violence parenting classes; administration; enforcement

A.  In addition to or prior to before entering a judgment pursuant to article 4 of this chapter, the court may order parents or guardians of a child referred to the court and such child to attend any of the following:

1.  Family counseling programs administered by the court pursuant to this article.

2.  Antigang violence parenting classes administered by the court.

B.  The court shall determine the frequency of attendance at the counseling sessions or parenting classes provided for in subsection A of this section, the times and locations thereof and the areas of counseling to be emphasized shall be as determined by the court.  The court may employ personnel and delegate to public and private agencies execution of the family counseling programs or antigang violence parenting classes.  Payment for services necessary to carry out the provisions of this section shall be a county charge to the matching funds as provided in this article.

C.  Antigang violence parenting classes ordered pursuant to this section may include any of the following criteria:

1.  A meeting in which the families of innocent victims of gang violence share their experiences.

2.  A meeting in which the surviving parents of a deceased gang member share their experiences.

3.  How to identify gang and drug activity in children.

4.  How to communicate effectively with adolescents.

5.  An overview of pertinent support agencies and organizations for intervention, education, job training and positive recreational activities, including telephone numbers, locations and contact names of those agencies and organizations.

6.  The potential penalties that may be imposed on parents for aiding and abetting crimes committed by their children.

C.  D.  The juvenile division of the superior court shall inquire into the ability of the minor, his the minor's estate, or parent or guardian or a person who has custody of such minor to bear the charge or expense of conducting counseling sessions or parenting classes provided for by this article.  If the court is satisfied that the minor, his the minor's estate, or parent or guardian or a person who has custody of such minor can bear such charge or expense, the court may fix the amount thereof and direct that the minor, his the minor's estate, or parent or guardian or a person who has custody of such minor pay such amount to the clerk of the court on terms directed by the court.  The clerk of the court shall acknowledge receipt of the money received to the person paying same. The clerk of the court shall transmit such money to the state treasurer for deposit in the state general fund. END_STATUTE
