An Act

 

amending title 16, chapter 1.1, article 1, Arizona Revised Statutes, by adding section 16-194; relating to civil proceedings.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 16, chapter 1.1, article 1, Arizona Revised Statutes, is amended by adding section 16-194, to read:

START_STATUTE16-194. Prohibited settlement agreement or consent decree; applicability

In any civil proceeding in a court of competent jurisdiction in which the constitutionality, legality or application of any provision of this title is at issue, a party that represents this state or an agency or political subdivision of this state may not agree to or sign a settlement agreement or consent decree. this section does not apply to any provision of chapter 6, article 2 of this title. END_STATUTE
