AN ACT

 

amending title 28, chapter 3, article 5, Arizona Revised Statutes, by adding section 28‑696; relating to driving violations.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Heading change

The article heading of title 28, chapter 3, article 5, Arizona Revised Statutes, is changed from "RECKLESS AND AGGRESSIVE DRIVING" to "DRIVING VIOLATIONS".

Sec. 2.  Title 28, chapter 3, article 5, Arizona Revised Statutes, is amended by adding section 28-696, to read:

START_STATUTE28-696.  Distracted driving; violation; civil penalties; traffic survival school; license suspension

A.  A person MAY not drive a motor vehicle while distracted.  A person violates this section if while operating a motor vehicle the person engages in any activity that is not related to the actual operation of the motor vehicle in a manner that interferes with the person's ability to exercise ordinary and reasonable control in the operation of the motor vehicle.

B.  A person who violates this section is subject to the following:

1.  Except as provided in paragraphs 2, 3 and 4 of this subsection, a civil penalty of not more than $50.

2.  For a second violation within twelve months after the first violation, a civil penalty of not more than $125.

3.  For a third violation within twelve months after the first violation, a civil penalty of not more than $50 and the court shall order the person to attend traffic survival school.

4.  For a fourth violation within twelve months after the first violation, the department shall suspend the person's driver license, permit or privilege to drive for a period of at least three months but not more than six Months. END_STATUTE
