AN ACT

 

Amending Title 36, chapter 5.1, article 1, Arizona Revised Statutes, by adding section 36-575; relating to developmental disabilities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 5.1, article 1, Arizona Revised Statutes, is amended by adding section 36-575, to read:

START_STATUTE36-575.  Care providers; contractual requirements; agencies

A.  The Arizona health care cost containment system administration, the department of economic security and the department of health services shall not issue new, or revise existing, contractual requirements, directives, policies or rules or any other authoritative action that will increase costs to direct care providers of service to persons with developmental disabilities.

B.  Before issuing a new or revised policy, procedure, form or process relating to direct care providers that is not specifically required by state or federal law, the Arizona health care cost containment system administration, the department of economic security and the department of health services shall conduct an economic small business and consumer impact analysis to determine the extent of the burden that would be caused by the policy, procedure, form or process, including:

1.  The probable costs and benefits to the state agency of implementing the change.

2.  The probable costs and benefits to businesses directly affected by the proposed change, including any anticipated effect on the revenues or payroll expenditures of employers who are subject to the change.

3.  The administrative and other costs required for compliance with the proposed change. END_STATUTE
