AN ACT

 

amending section 13-2910.05, Arizona Revised Statutes; amending title 13, chapter 29, Arizona Revised Statutes, by adding section 13-2910.10; relating to animal fighting.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 13-2910.05, Arizona Revised Statutes, is amended to read:

START_STATUTE13-2910.05. Exempt activities

Activity involving the possession, training, exhibition or use of an animal in the otherwise lawful pursuits of hunting, ranching, farming, rodeos, shows and security services shall be exempt from the provisions of sections 13-2910.01, 13-2910.02, 13-2910.03 and 13-2910.04 and 13-2910.10. Sec. 2. Title 13, chapter 29, Arizona Revised Statutes, is amended by adding section 13-2910.10, to read:

START_STATUTE13-2910.10. Ownership, possession, purchase, sale, transfer or manufacture of animal fighting paraphernalia; classification; definition

A. It is unlawful for a person to knowingly own, possess, purchase, sell, transfer or manufacture animal fighting paraphernalia for the purpose of engaging in, promoting or facilitating animal fighting pursuant to section 13-2910.01 or cockfighting pursuant to section 13-2910.03.

B. A person who violates this section is guilty of a class 1 misdemeanor.

C. For the purposes of this section, "animal fighting paraphernalia":

1. Means equipment, products, implements or materials of any kind that are used, intended for use or designed solely for use in animal fighting or cockfighting or training, preparing, conditioning or furthering animal fighting or cockfighting.

2. Includes breaking sticks, cat mills, treadmills, fighting pits, springpoles, gaffs, slashers and heels and other sharp implements that are designed to be attached in place of the natural spur of a cock or game fowl. END_STATUTE
