HOUSE BILL 2457

 

 

AN ACT

 

changing the designation of title 22, chapter 6, Arizona Revised Statutes, to "HOMELESS, VETERANS AND MENTAL HEALTH courts"; amending sections 22‑601 and 22‑602, Arizona Revised Statutes; relating to homeless, veterans and mental health courts.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Heading change

The chapter heading of title 22, chapter 6, Arizona Revised Statutes, is changed from "HOMELESS COURT" to "HOMELESS, VETERANS AND MENTAL HEALTH COURTS".

Sec. 2.  Section 22-601, Arizona Revised Statutes, is amended to read:

START_STATUTE22-601.  Homeless, veterans and mental health courts; establishment; eligibility for referral

A.  The presiding judge of the superior court in each county may establish a homeless court, veterans court and mental health court to adjudicate cases filed in a justice court or a municipal court in the county.

B.  The presiding judge of the superior court shall establish the eligibility criteria for referral to the homeless court, veterans court or mental health court.

C.  A justice of the peace or municipal court judge who has jurisdiction over a case that meets the eligibility criteria may refer the case to the homeless court, veterans court or mental health court.

D.  The originating court shall notify the prosecutor of any criminal case referred to the homeless court, veterans court or mental health court. END_STATUTE

Sec. 3.  Section 22-602, Arizona Revised Statutes, is amended to read:

START_STATUTE22-602.  Homeless, veterans and mental health courts jurisdiction; judicial officer's authority to adjudicate

A.  The originating justice court or municipal court shall maintain jurisdiction of a case that is referred to the homeless court, veterans court or mental health court pursuant to section 22‑601.

B.  Any judicial officer in the county where the offense occurred shall have the authority to adjudicate a case referred to the homeless court, veterans court or mental health court. END_STATUTE
