AN ACT
amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.41; amending title 11, chapter 2, article 4, Arizona Revised Statutes, by adding section 11-269.20; relating to local services.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.41, to read:
9-500.41. Identification cards; state preemption; municipal service access cards; requirements; prohibitions; applicability; fee
A. The regulation of the issuance of state and local identification cards to individuals in this state is of statewide concern and not subject to further regulation by a city or town.
B. A city or town may issue a municipal service access card to an individual only to provide access to municipal services that the individual is entitled to receive by law from the city or town. If a city or town issues a municipal service access card to an individual to provide access to municipal services that the individual is entitled to receive by law from the city or town, the city or town shall:
1. Include the following label, in at least twelve-point bold-faced type, on the first line of the municipal service access card: "not an identification card—for use to access municipal services only".
2. Not suggest in any way that the municipal service access card may be used for personal identification or print the word "identification" or the abbreviation "ID" or "I.D." on the municipal service access card, except that a municipal service access card may state that the municipal service access card is not an identification card.
3. List on the municipal service access card only the services that the individual to whom the municipal service access card is issued is legally entitled to receive from the city or town.
C. A city or town that issues to an individual a municipal service access card to access municipal services that the individual is legally entitled to receive from the city or town that also serves as an identification card shall both:
1. Contract with and adhere to all of the requirements of the motor vehicle division of the department of transportation for verifying the individual's identity.
2. Reimburse the department of transportation for all costs associated with providing the services described in paragraph 1 of this subsection.
D. A municipal service access card issued pursuant to this section may not have the same color scheme or design format as a driver license issued pursuant to section 28-3153 or a nonoperating identification license issued pursuant to section 28-3165.
E. This section also applies to municipal service access cards that are issued by a third party on behalf of a city or town.
F. A city or town may charge a reasonable fee to an individual to recover the costs associated with issuing that individual's municipal service access card.
Sec. 2. Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.20, to read:
11-269.20. Identification cards; state preemption; county service access cards; requirements; prohibitions; applicability; fee
A. The regulation of the issuance of state and local identification cards to individuals in this state is of statewide concern and not subject to further regulation by a county.
B. A county may issue a county service access card to an individual only to provide access to county services that the individual is entitled to receive by law from the county. If a county issues a county service access card to an individual to provide access to county services that the individual is entitled to receive by law from the county, the county shall:
1. Include the following label, in at least twelve-point bold-faced type, on the first line of the county service access card: "not an identification card—for use to access county services only".
2. Not suggest in any way that the county service access card may be used for personal identification or print the word "identification" or the abbreviation "ID" or "I.D." on the county service access card, except that a county service access card may state that the county service access card is not an identification card.
3. List on the county service access card only the services that the individual to whom the county service access card is issued is legally entitled to receive from the county.

Sec. 3. Applicability
Sections 9-500.41 and 11-269.20, Arizona Revised Statutes, as added by this act, apply to all municipal and county service access cards issued, reissued or renewed on or after the effective date of this act. A municipal or county service access card that is issued before the effective date of this act is valid for one year after the effective date of this act.
