AN ACT

 

amending Title 16, chapter 3, article 5, Arizona Revised Statutes, by adding section 16-345; relating to nominating procedures.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 16, chapter 3, article 5, Arizona Revised Statutes, is amended by adding section 16-345, to read:

START_STATUTE16-345.  United States senator; nomination by legislature

A.  Any person who is otherwise qualified by law to serve as a United States senator and who has not been nominated for that office by a political party nomination as prescribed in section 16-301, by nomination other than by political party nomination as prescribed by section 16-341 or by a delegate convention as prescribed by section 16-342 may be nominated as a candidate for the office of United States senator pursuant to this section.

B.  The candidate shall file a nomination petition that states that the office of United States senator is the office to be filled, the name and residence address of the candidate and other information as required by this section.  The nomination petition shall be filed with the presiding officers of the state house of representatives and the state senate at the same time as primary nomination papers and petitions are required to be filed.

C.  The nomination petition shall be in substantially the following form:

"The undersigned duly elected legislators of the state of Arizona do hereby nominate____________________, who resides at ______________ in the county of ______________ as a candidate for the office of United States senator at the general (or special, as the case may be) election to be held on the ____ day of _________.

I hereby declare that I have not signed the nomination petition of any candidate for the office to be voted for at the primary election, and I do hereby select the following designation under which name this candidate shall be placed on the official ballot:  State legislature candidate for United States senate."

D.  The nomination petition shall be signed by at least twenty per cent of the members of the legislature then holding office.

E.  Within thirty days after the nomination petition is filed with each presiding officer, a committee of the whole in each chamber of the legislature shall be called to consider each nomination made pursuant to this section and shall promptly and simultaneously vote on each candidate so nominated to the office of United States senator.  The candidate receiving the greatest number of votes cast for that office is deemed eligible for the office of United States senator and that candidate's name shall be printed on the official ballot for the office of United States senator at the next ensuing general (or special, as the case may be) election. Sec. 2.  Short title

This act may be cited as the "Equal State Suffrage Act".
