AN ACT

 

amending section 15-1601, Arizona Revised Statutes; relating to economic development.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 15-1601, Arizona Revised Statutes, is amended to read:

START_STATUTE15-1601.  State universities; location; faculty powers

A.  The Arizona board of regents shall maintain state universities at Flagstaff in Coconino county, at Tempe in Maricopa county, and at Tucson in Pima county and in Yuma county, and the universities are respectively designated northern Arizona university, Arizona state university, and the university of Arizona and yuma university.  The board shall maintain an Arizona state university campus in western Maricopa county designated as Arizona state university west campus, which shall be identified as a separate budget unit in the general appropriations act.  The board shall maintain an Arizona state university campus in eastern Maricopa county designated as Arizona state university east campus, which shall be identified as a separate budget unit in the general appropriations act.  The board may establish and maintain other colleges and universities subject to legislative authority.� Subject to review by the joint committee on capital review, the board may establish new campuses that are separate from any location in existence on July 1, 2007.  The Arizona state university campus at Tempe shall provide administrative support for the Arizona state university campuses in western Maricopa county and in eastern Maricopa county.

B.  The universities shall have colleges, schools and departments and give courses of study and academic degrees as the board approves.  Subject to the responsibilities and powers of the board and the university presidents, the faculty members of the universities, through their elected faculty representatives, shall share responsibility for academic and educational activities and matters related to faculty personnel.  The faculty members of each university, through their elected faculty representatives, shall participate in the governance of their respective universities and shall actively participate in the development of university policy. Sec. 2.  Discontinuation of Yuma community college; transition to Yuma university

A.  On the effective date of this act, the governing board of the Yuma community college district shall discontinue operations at the Yuma community college.

B.  On the effective date of this act, the Yuma community college campus is redesignated as Yuma university.

C.  On the effective date of this act, the Arizona board of regents succeeds to the authority, powers, duties and responsibilities of the governing board of the Yuma community college district with respect to all matters concerning the campus formerly designated as Yuma community college.

D.  This act does not alter the effect of any actions that were taken or impair the valid obligations of the governing board of the Yuma community college district or Yuma county with respect to the campus formerly designated as Yuma community college.

E.  All administrative matters, contracts and judicial and quasi‑judicial actions concerning the campus formerly designated as Yuma community college, whether completed, pending or in process, of the governing board of the Yuma community college district on the effective date of this act are transferred to and retain the same status with the Arizona board of regents.

F.  Any student who was enrolled at the campus formerly designated as Yuma community college on the effective date of this act and who has not completed the academic requirements for the degree that the student was pursuing shall be granted automatic admission, subject to the payment of the appropriate tuition and fees, to Yuma university. Any academic credits earned before the effective date of this act by a student enrolled at the campus formerly designated as Yuma community college shall be automatically accepted by Yuma university.

G.  All personnel who were employed at Yuma community college on the effective date of this act are transferred to comparable positions and pay classifications at Yuma university.

H.  All real property, equipment, records, furnishings and other property located at the campus formerly designated as Yuma community college and all monies appropriated to the Yuma community college district that remain unexpended and unencumbered on the effective date of this act are transferred to Yuma university.

Sec. 3.  Foreign trade zone application

Pursuant to section 44-6501, Arizona Revised Statutes, the governor shall apply to the foreign trade zones board, United States department of commerce, to establish a foreign trade zone for all of the city of Yuma, except for the areas currently located in foreign trade zone number 219.
