AN ACT

 

amending title 44, chapter 19, article 1, Arizona Revised Statutes, by adding section 44‑6552; relating to solicitation of funds for charitable purposes.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 44, chapter 19, article 1, Arizona Revised Statutes, is amended by adding section 44-6552, to read:

START_STATUTE44-6552.  Disclosures; violation; classification

A.  On all solicitations, including print solicitations, direct mail solicitations and solicitations on radio, television and social media, a charitable organization, a contracted fund-raiser or an independent solicitor must disclose all of the following:

1.  The total amount of monies collected in this state during the previous calendar year or the last year when monies were collected for the charitable organization.

2.  The percentage of the monies described in paragraph 1 of this subsection that was spent exclusively in this state.

3.  A brief description of the purpose for which the monies described in paragraph 2 of this subsection were spent.

B.  The disclosure described in subsection A of this section shall be written in a clear and concise manner so that a person with at least a high school education is able to easily understand the disclosure.

C.  A person who violates this section is guilty of a class 1 misdemeanor.END_STATUTE
