AN ACT

 

amending Title 45, chapter 2, article 8.1, Arizona Revised Statutes, by adding section 45-551.01; relating to the groundwater code.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 45, chapter 2, article 8.1, Arizona Revised Statutes, is amended by adding section 45-551.01, to read:

START_STATUTE45-551.01.  Colorado river water shortage emergency; groundwater transportation

A.  Groundwater that is withdrawn in a groundwater basin or sub-basin that is outside of an initial active management area and that is adjacent to or reasonably accessible to the central Arizona project canal system may be transported to an initial active management area if both of the following apply:

1.  The initial active management area is at significant, imminent risk of forced reductions in deliveries of Colorado river water due to near‑shortage conditions on the Colorado river system.

2.  The governor issues a formal declaration of Colorado river water shortage emergency for the specific purpose of allowing the groundwater transportation prescribed by this section.

B.  Groundwater transported pursuant to this section may be used only in the initial active management area and may not be transported or used outside this state.END_STATUTE
