HOUSE BILL 2233

 

 

 

AN ACT

 

amending section 12‑109, Arizona Revised Statutes; relating to the supreme court.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 12-109, Arizona Revised Statutes, is amended to read:

START_STATUTE12-109.  Rules of pleading, practice and procedure; adoption; distribution

A.  The supreme court, by rules promulgated from time to time rule, shall regulate pleading, practice and procedure in judicial proceedings in all courts of the this state for the purpose of simplifying such to simplify pleading, practice and procedure and promoting promote speedy determination of litigation upon on its merits.  The rules shall not abridge, enlarge or modify substantive rights of a litigant.

B.  The supreme court shall print and distribute the rules to all members of the state bar and to all other persons who apply.

C.  Notwithstanding any other law, the supreme court may adopt rules that govern signatures on court documents, including implementing electronic signatures, that require a sworn written declaration, verification, certificate, statement, oath or affidavit.

C.  D.  The rules shall not become effective until sixty days after distribution. END_STATUTE
