HOUSE BILL 2226

 

 

An Act

 

amending title 41, chapter 12, article 2, Arizona Revised Statutes, by adding section 41-1735; appropriating monies; relating to the department of public safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 41, chapter 12, article 2, Arizona Revised Statutes, is amended by adding section 41-1735, to read:

START_STATUTE41-1735. Fentanyl prosecution and testing fund

A. The fentanyl prosecution and testing fund is established consisting of monies appropriated to the fund by the legislature. The department shall administer the fund. Monies in the fund are continuously appropriated. the department shall allocate monies in the fund on a first-come, first-served basis to:

1. County attorneys, county sheriffs and courts to reimburse costs related to fentanyl prosecutions in this state.

2. Law enforcement agencies in this state to reimburse costs related to fentanyl testing.

B. Monies in the fentanyl prosecution and testing fund are exempt from the provisions of section 35-190 relating to lapsing of appropriations. END_STATUTE

Sec. 2. Appropriation; fentanyl prosecution and testing fund

The sum of $5,000,000 is appropriated from the state general fund in fiscal year 2023-2024 to the fentanyl prosecution and testing fund established by section 41-1735, Arizona Revised Statutes, as added by this act.
