AN ACT

 

amending title 13, chapter 14, Arizona Revised Statutes, by adding section 13-1412, Arizona Revised Statutes; relating to sexual offenses.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 14, Arizona Revised Statutes, is amended by adding section 13-1412, to read:

START_STATUTE13-1412.  Unlawful exposure to the human immunodeficiency virus or a sexually transmitted disease; classification; definition

A.  It is unlawful for a person who knows he is infected with the human immunodeficiency virus or a sexually transmitted disease to knowingly do any of the following:

1.  Engage in sexual intercourse or sodomy with another individual with the intent to expose that individual to the virus or disease.

2.  Sell or donate one's own blood, blood products, semen, tissue, organs or other body fluids with the intent to expose the recipient to the virus or disease.

3.  Share with another individual a hypodermic needle or syringe, or both, for the introduction of drugs or any other substance into, or for the withdrawal of blood or body fluids from, the other individual's body with the intent to expose another person to the virus or disease.

B.  A person who violates this section is guilty of a class 6 felony.

C.  For the purposes of this section, "sexually transmitted disease" includes Chlamydia, Genital herpes, Gonorrhea, Syphilis, chancroid, granuloma inguinale, lymphogranuloma venereum and Trichomonas.END_STATUTE
