AN ACT

 

Amending title 36, chapter 4, article 3, Arizona Revised Statutes, by adding section 36-438; relating to health care institutions.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 4, article 3, Arizona Revised Statutes, is amended by adding section 36-438, to read:

START_STATUTE36-438. Hospitals; charges for prescription drugs and devices; limit; definitions

A. A hospital may not charge more than the medicare part B reimbursement rate, or ten percent over the hospital's acquisition cost if there is no applicable medicare part B reimbursement rate, for prescription medication or a prescription-only device.

B. For the purposes of this section, "prescription medication" and "prescription-only device" have the same meanings prescribed in section 32-1901. END_STATUTE
