AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36‑2930.02; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36‑2930.02, to read:

START_STATUTE36-2930.02.  Third‑party coverage; audit; cost avoidance and recovery methodology

A.  On or before July 1 of each year, the administration shall conduct an audit of the primacy of its payments by matching the identities of its members electronically using the transactions mandated pursuant to 42 United States Code section 1320d against the enrollment of all other health plans.  The administration must file the results of its audit with the department of insurance on or before September 1 of each year. 

B.  The administration shall submit a copy of each annual audit to the governor, the speaker of the house of representatives, the president of the senate, the joint legislative budget committee and the secretary of state on or before September 1 of each year.

C.  The administration shall propose and issue a public request for proposals for a contract to provide for a cost avoidance and recovery methodology relating to determining third‑party liability and coordination of benefits.  The request for proposals shall be reviewed by the joint legislative audit committee before it is issued.  a contract awarded by the administration pursuant to a public request for proposals to assist the administration in determining third‑party liability and coordination of benefits shall require an offeror to demonstrate a cost avoidance methodology as part of the proposal submission.  The contract shall provide for the payment of contractor services through the costs recovered by the recovery methodology provided and operated by the contractor and shall specify reasonable reimbursement limits.
