AN ACT

 

Amending title 49, chapter 2, article 6, Arizona Revised Statutes, by adding section 49‑311; relating to fish eradication.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 49, chapter 2, article 6, Arizona Revised Statutes, is amended by adding section 49-311, to read:

START_STATUTE49-311.  Moratorium

A.  A person shall not, through any means other than mechanical, eradicate existing fish populations as part of a native fish reintroduction program from any spring, seep, stream, river, stockpond, lake or any other body of standing or running water in the sonoita creek watershed from the effective date of the moratorium imposed by this section until may 1, 2012.

B.  A person who violates this section is guilty of endangerment as prescribed in Section 13-1201. END_STATUTE

Sec. 2.  Joint legislative study committee on human health risks associated with fish eradication; report; delayed repeal

A.  A joint legislative study committee on human health risks associated with fish eradication is established to consider the methods of eradicating fish populations in the waters of this state.  The committee consists of:

1.  Three members of the senate who are appointed by the president of the senate, no more than two of whom may be from the same political party.

2.  Three members of the house of representatives who are appointed by the speaker of the house of representatives, no more than two of whom may be from the same political party.

B.  The committee shall:

1.  Identify the risks posed to human health from the use of fish eradication methods in sources of potable waters in this state, including health hazards and short and long term health impacts.

2.  Analyze any risks posed to the environment, downstream potable water supply or livestock water supply from the use of fish eradication methods.

3.  Review fish eradication practices in use in this state.

4.  Consider alternative methods of fish eradication.

5.  Review the process by which the state determines how to eradicate fish populations as that process relates to human health, including site specific consideration, notice to the public and an opportunity to comment, timing, methods of control, application and monitoring.

6.  Consider any other issues related to fish eradication practices as related to human health.

7.  Submit a report of the committee’s findings and recommendations on or before December 31, 2011 to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of the report to the secretary of state.

C.  This section is repealed from and after September 30, 2012.

Sec. 3.  Delayed repeal

Section 49-311, Arizona Revised Statutes, as added by this act, is repealed from and after June 30, 2012.

Sec. 4.  Retroactivity

This act is effective retroactively to from and after April 30, 2011.
