HOUSE BILL 2090

 

 

 

AN ACT

 

providing for the adoption by the state land department of licensing time frame rules.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  State land department; rulemaking; licensing time frames; delayed repeal

A.  The state land department is an agency as defined in section 41‑1001, Arizona Revised Statutes, for the purposes of complying with title 41, chapter 6, article 7.1, Arizona Revised Statutes.

B.  The state land commissioner shall:

1.  Adopt licensing time frame rules pursuant to title 41, chapter 6, article 7.1, Arizona Revised Statutes, including time frames for all applications that relate to the selling, leasing, annexation, conveyance, exchange, right‑of‑way and use of state lands or products of state lands that are managed by the state land department.

2.  File with the secretary of state a notice of proposed rulemaking for the rules required by this section on or before January 1, 2018.

3.  Have final rules in place on or before June 30, 2018.

C.  This section is repealed from and after December 31, 2020.
