An Act

 

amending section 11-269.28, Arizona Revised Statutes; relating to food handler certificates.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 11-269.28, Arizona Revised Statutes, is amended to read:

START_STATUTE11-269.28. Food handler certificate; volunteers; exemption; definition

A. A county may not require a person who volunteers at a school activity or function where food is being handled or served outside of the school's regular food service to students to obtain a food handler certificate or identification card or participate in a food handler certificate training course pursuant to section 11-269.12 if the person is overseen by a certified food protection manager or person in charge as defined in Arizona administrative code R9-8-101(c)(3)(g).

b. A county may not require a person who volunteers three or fewer times in a calendar year at an activity or function where food is being packaged or heated to obtain a food handler certificate or identification card or participate in a food handler certificate training course pursuant to section 11-269.12 if the person is overseen by a certified food protection manager or person in charge.

C. For the purposes of this section, "person in charge" means the individual present at a food establishment who is responsible for the management of the operation of the food establishment at the time of inspection. END_STATUTE
