Between lines 28 and 19, insert:

"5.  Before any conveyance, lease or sublease pursuant to paragraph 2, 3 or 4 of this subsection, the department shall ensure the use or development of any real estate, property rights and related infrastructure, real property or any improvements to real property complies with section 28-8481."
