HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2421

Strike everything after the enacting clause and insert:
"Section 1. Title 39, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 39-206, to read:
39-206. Posting of public records; public notices; enforcement; civil penalty; costs and attorney fees
The attorney general, the county attorney for the county in which an alleged violation occurred or any person who is affected by an alleged violation of any law that requires a public record or public notice to be posted on a public body's website may commence a suit in the superior court in the county in which the public body is located for the purpose of requiring compliance with any law that requires a public record or public notice to be posted. For each violation the court may impose a civil penalty not to exceed five hundred dollars against a person who violates any law that requires a public record or public notice to be posted on a public body's website and order such equitable relief as it deems appropriate in the circumstances. The court may also award costs and reasonable attorney fees to a successful plaintiff in a suit brought under this section."
