         Committee on Transportation --  committee  discharged,  bill  amended,

       AN  ACT  to  amend  the navigation law, in relation to requiring certain
         persons to obtain a boating  safety  certificate  prior  to  operating
         water craft
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Subdivision 9 of section 49-b of  the  navigation  law  is
    2  amended by adding a new paragraph (d) to read as follows:
    3    (D)  A  PERSON  WHO IS SUBJECT TO A SUSPENSION OF OPERATING PRIVILEGES
    4  PURSUANT TO THIS SUBDIVISION SHALL  ALSO  BE  REQUIRED  TO  SUCCESSFULLY
    5  OBTAIN  A BOATING SAFETY CERTIFICATE ISSUED TO HIM OR HER BY THE COMMIS-
    6  SIONER, THE UNITED STATES POWER SQUADRONS OR  THE  UNITED  STATES  COAST
    7  GUARD AUXILIARY PRIOR TO BEING ELIGIBLE TO OPERATE A VESSEL.
    8    S 2. This act shall take effect immediately.
