FISCAL NOTE

Senate Bill 358 as passed the Senate would prohibit the state and any political subdivision, and any appointed or elected official in the state from enforcing any federal act, law, order, rule, or regulation that regulates the possession, use, or manufacture of any firearm, ammunition, or firearm accessory and imposes penalties for violations under certain circumstances. This bill could increase the obligations of the Office of Attorney General, by an undetermined amount, to: (1) seek action against any political subdivision in the state for violations of this bill as a result of a valid compliant filed by a resident of that political subdivision; this increase would be offset by a court award for reasonable expenses; and (2) defend any resident against federal allegations of violations of federal laws or regulations relating to the manufacture, sale, transfer, or possession of firearms ammunition, or firearm accessories. This bill could also decrease state grant revenues to any political subdivision of the state that violates this bill by an undetermined amount dependent on the grant revenues otherwise received by the political subdivision.

In addition this bill could increase receipts to the State General Fund and municipal general funds from fines; increase receipts to the State General Fund, county general funds, municipal general funds, and other funds to which court costs are deposited; and could increase the obligations of the State General Fund, district attorneys, and local jails by an undetermined amount dependent upon the number of persons charged with and convicted of the offenses provided by this bill and the penalties imposed.
