       AN ACT to amend the vehicle and traffic law, in relation to  distinctive
         license  plates  issued  to  members  of the United States Naval Armed
         Guard
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section 404-v of the vehicle and traffic law, as added by
    2  chapter 389 of the laws of 2004, is amended to read as follows:
    3    S 404-v. Distinctive plates for the United States Naval  Armed  Guard.
    4  1.  Any  honorably  discharged  member  of the United States Naval Armed
    5  Guard, OR THE SPOUSE, WIDOW, OR WIDOWER OF SUCH MEMBER, residing in this
    6  state shall, upon request, be issued a license plate bearing  the  words
    7  "United  States  Naval Armed Guard", or such other phrase as the commis-
    8  sioner shall designate showing  the  registrant  served  in  the  United
    9  States  Naval  Armed  Guard. Application for such license plate shall be
   10  filed with the commissioner in such form and detail as the  commissioner
   11  shall prescribe.
   12    2.  The distinctive plate authorized pursuant to this section shall be
   13  issued upon proof, satisfactory to the commissioner, that the  applicant
   14  is an honorably discharged veteran who served in the United States Naval
   15  Armed  Guard.  IF  A  DISTINCTIVE  LICENSE  PLATE IS ISSUED TO A VETERAN
   16  PURSUANT TO THIS SECTION, SUCH A DISTINCTIVE PLATE SHALL NOT  BE  ISSUED
   17  TO THE SPOUSE OF SUCH VETERAN.
   18    3. A distinctive plate issued pursuant to this section shall be issued
   19  in  the  same  manner as other number plates upon payment of the regular
   20  registration fee prescribed by section four hundred one of this article,
   21  provided, however, that an additional one-time  service  charge  of  ten
   22  dollars  shall  be  charged  for such plate. Provided, however, that one
   23  year after the effective date of this section funds  in  the  amount  of
   24  five  thousand dollars, or so much thereof as may be available, shall be
   25  allocated from such funds to the department to offset  costs  associated
   26  with the production of such license plates.
   27    S 2. This act shall take effect immediately.
