Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 3.2-6592.1 as follows:
§3.2-6592.1. Breeding dogs for certain research prohibited.
A. No person who has received from the U.S. Department of Agriculture, pursuant to enforcement of the federal Animal Welfare Act (7 U.S.C. §2131 et seq.) or regulations adopted thereunder, a citation for a direct or critical violation on or after July 1, 2023, shall breed or raise a dog for the purpose of selling or transferring the dog, or its offspring, for a period of two years after receiving such citation, to an animal testing facility (i) located outside of the United States or (ii) located in the United States for use in animal testing or research not required by federal law or regulation.
B. Any person who has received a citation described in subsection A who no longer has a need for a dog or cat in his possession that does not pose a health or safety risk to the public or to the welfare of the animal shall (i) offer for release such dog or cat to a releasing agency for eventual adoption or for adoption through a private placement; (ii) develop his own adoption program, provided that such program maintains records that comply with §3.2-6557; or (iii) enter into an agreement with a releasing agency for the implementation of the provisions of this subsection.
2. That the provisions of this act shall not become effective unless reenacted by the 2023 Session of the General Assembly.
