A BILL to amend the Code of Virginia by adding in Article 5 of Chapter 2 of Title 28.2 a section numbered 28.2-232.1, relating to suspension of commercial fishing privileges in tidal waters.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 5 of Chapter 2 of Title 28.2 a section numbered 28.2-232.1 as follows:

§28.2-232.1. Suspension of commercial fishing privileges in tidal waters.

The Commission may suspend for five years the fishing privileges in the tidal waters of any commercial fisherman, as defined in subsection D of §28.2-241, who has violated provisions of Chapters 2 through 8 (§28.2-200 et seq.) of Subtitle II, Tidal Fisheries, five times or more in any two-year period. Such suspension shall occur if, after a hearing held after 10 days' notice to the commercial fisherman, the Commission finds that the person is guilty of the violations.

An appeal from the Commission's decision may be taken to the courts as provided in Article 3 (§28.2-216 et seq.)
