A BILL to amend the Code of Virginia by adding a section numbered 33.1-23.03:3.1, relating to allocation from the Transportation Trust Fund to certain homeowners' associations.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 33.1-23.03:3.1 as follows:

§ 33.1-23.03:3.1. Allocations to certain homeowners' associations.

The Commonwealth Transportation Board shall annually set aside from all funds available for highway maintenance and construction $50 million to be distributed among homeowners' associations within the Commonwealth for use exclusively for highway maintenance and maintenance replacement. Allocations pursuant to this section shall be made only among those homeowners' associations that have had an uninterrupted existence of at least 25 years prior to any allocation under this section. Allocations among eligible homeowners' associations shall be at the discretion of the Commonwealth Transportation Board.
