Senate Amendments in [ ] – February 7, 2020
A BILL to amend and reenact §22.1-291.1 of the Code of Virginia, relating to school boards; teachers; planning time and planning periods.

Be it enacted by the General Assembly of Virginia:

1. That §22.1-291.1 of the Code of Virginia is amended and reenacted as follows:

§22.1-291.1. Planning time and planning periods for elementary, middle, and high school teachers.

Each school board shall ensure that all (i) each elementary school teachers teacher in its employment are is provided at least an average of 30 minutes one 45-minute period per school day during the students' school week as planning time and (ii) each middle and high school teacher is provided [ an average of ] one planning period per school day or the equivalent, which shall be at least 45 minutes or one class period, whichever is longer. Such planning time or planning period shall be unencumbered and otherwise uninterrupted except in the case of the emergency need for classroom support or another emergency situation, provided, however, that a school board may offer and a teacher may agree to an appropriate contractual arrangement and compensation in lieu of such planning time or planning period.

[ 2. That the provisions of this act shall not become effective unless an appropriation effectuating the purposes of this act is included in a general appropriation act passed in 2020 by the General Assembly that becomes law. ]
