A BILL to amend the Code of Virginia by adding in Article 3 of Chapter 2 of Title 32.1 a section numbered 32.1-48.002, relating to vaccines; adverse events; reporting.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 2 of Title 32.1 a section numbered 32.1-48.002 as follows:

§32.1-48.002. Reporting of information related to adverse vaccine events.

A. As used in this section, "adverse event" means an adverse reaction to administration of a vaccine, including any side effects or other reactions to administration of a vaccine.

B. The Department shall establish a process by which the Department shall receive reports of adverse events provided by health care providers and members of the public and shall prominently display information regarding how health care providers and members of the public may report adverse events on its website. The Department shall make information regarding reported adverse events available to the public on a website maintained by the Department. Such information shall be made available in a manner that is consistent with state or federal laws regarding health information privacy.

C. Every health care provider who reports an adverse event to the Vaccine Adverse Event Report System administered by the Centers for Disease Control and Prevention and the U.S. Food and Drug Administration shall report such adverse event to the Department.
