12101174D Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding a section numbered 23-22.1 as follows: §23-22.1. Use of general fund appropriations; Virginia Freedom of Information Act. A. Notwithstanding any other provision of law, if funds from any university-related foundation are used to pay for any cost related to the enforcement of the Virginia Freedom of Information Act (§2.2-3700 et seq.) incurred by an institution of higher education referred to in §23-14 affiliated with such foundation, the foundation shall be required to provide to the institution a list of all persons who have made donations to the foundation within the prior three years, including the name, address, and aggregate amount of contributions made by each donor. The institution shall disclose this list to any party upon receiving a valid request under the Virginia Freedom of Information Act (§2.2-3700 et seq.), and shall not make any attempt to withhold the list. B. The provisions of this section shall not apply to any donor to the university-related foundation where the donation was specifically directed by the donor to be used for (i) the endowment of any professorship, scholarship, or other place or appointment in the institution or (ii) the construction of any capital improvement project at the institution. |
