Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 56-446.2 as follows:

§56-446.2. Limitation on assessments made by certain heavy rail operators.

No operator of a rapid heavy rail commuter mass transportation system operating on an exclusive right-of-way and a bus commuter mass transportation system owned, operated, or controlled by an agency or a commission as defined in §15.2-4502 or in any transportation district that is subject to subsection C of §15.2-4515 shall assess any locality for provision of its rapid heavy rail commuter mass transportation service, in any year, more than that locality collected in that year through the imposition and collection of a motor vehicle fuel sales tax pursuant to Article 4 (§58.1-1718.1 et seq.) of Chapter 17 of Title 58.1.
