Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-130.1 as follows:

§18.2-130.1. Use of unmanned aircraft system to trespass; penalty.

Any locality may by ordinance prohibit the use of an unmanned aircraft system as defined in §19.2-60.1 to trespass upon the property of others within its boundaries. Such ordinance may provide that landowners may exclude such aircraft from a column of airspace extending from the surface of their land up to 350 feet above ground level. A person shall be guilty of a Class 4 misdemeanor if he operates such aircraft in violation of the ordinance.
