Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 65.2-810.1 as follows:
§65.2-810.1. Insurer's audit of premises; supervision by Commission employees.
A. An insurer issuing a policy of insurance against liability arising under this title, or an agent or employee of the insurer, shall not be authorized under the terms of the policy or other provision of this title to enter upon premises owned by the insured employer, or premises where the insured employer conducts business, for the purpose of conducting an audit, inspection, or other review of the employer's business unless the insurer, or its agent or employee, is accompanied by and is subject to supervision by an employee of the Commission.
B. The provisions of subsection A shall not apply if the employer consents prior to the entry to the insurer's conduct of the audit or inspection without the presence of or supervision by an employee of the Commission.
