AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee for Courts of Justice
on February 6, 2015)

A BILL to amend the Code of Virginia by adding a section numbered 2.2-3713.1, relating to the Virginia Freedom of Information Act; willful violations a misdemeanor; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 2.2-3713.1 as follows:

§2.2-3713.1. Additional penalty for willful and knowing violations.

In addition to the provisions of §§2.2-3713 and 2.2-3714, any officer, employee, or member of a public body who, without legal excuse or justification, deliberately, willfully, and knowingly violates §2.2-3704, 2.2-3705.1 through 2.2-3705.8, 2.2-3706, 2.2-3707, 2.2-3708, 2.2-3708.1, 2.2-3710, 2.2-3711, or 2.2-3712 is guilty of a Class 1 misdemeanor.
