A BILL to amend the Code of Virginia by adding in Article 10 of Chapter 10 of Title 46.2 a section numbered 46.2-1088.7, relating to installation of starter interrupt devices on certain motor vehicles.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 10 of Chapter 10 of Title 46.2 a section numbered 46.2-1088.7 as follows:

§46.2-1088.7. Installation of starter interrupt devices on certain motor vehicles prohibited.

A. For the purpose of this section, "starter interrupt device" means a piece of electronic equipment installed in a motor vehicle that, when activated, prevents the vehicle from starting.

B. No person other than the title owner of the vehicle shall install or cause to be installed, on any motor vehicle other than a commercial motor vehicle as defined in §46.2-341.4, any starter interrupt device. Furthermore, no person shall require the installation of a starter interruptor device as a condition of any motor vehicle purchase contract. Any contract that requires the installation of any starter interrupt device on any noncommercial motor vehicle is void.

C. Any person convicted of a violation of this section shall be liable to the owner of the motor vehicle for the cost of removal of the starter interrupt device and restoration of the vehicle's ignition system to good working order, statutory damages of $1,000, reasonable attorney's fees, and court costs in any civil action brought pursuant to this section.
