Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-821.1 as follows:
§46.2-821.1. Exception to stopping requirement; bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or motorized skateboard or scooter.
A. Notwithstanding the provisions of §46.2-821, any person operating a bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or motorized skateboard or scooter may yield instead of stop at an intersection of two highways controlled by a stop sign if all the following conditions are met:
1. Each intersecting highway has no more than 3 motor vehicle travel lanes;
2. The person is at least 15 years old or accompanied by an adult;
3. The person slows to a speed reasonable for the existing conditions;
4. Before proceeding into the intersection, the person yields the right-of-way to any pedestrian lawfully within the crosswalk, as required pursuant to §46.2-924, and to the driver of another vehicle approaching or entering such intersection from another direction; and
5. The person is not approaching a stop sign marked as a full-stop stop sign as provided in subsection B.
B. The Department of Transportation may mark any stop sign as a full-stop stop sign. For purposes of this section "full-stop stop sign" means any stop sign so designated by the Department of Transportation after an engineering study determination that site-specific conditions, including limited sight distances and hidden entrances, make it unsafe for a person to yield instead of stop at such stop sign as provided in subsection A. No stop sign shall be considered a full-stop stop sign for the purposes of this section unless such sign is clearly marked with a sign indicating the stop sign has been designated as a full-stop stop sign.
