16100733D Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding a section numbered 19.2-59.2 as follows: §19.2-59.2. Use of X-rays, etc.; search warrant required. A. For purposes of this section, "ionizing radiation" means gamma rays and X-rays, alpha and beta particles, high-speed electrons, neutrons, protons, and other nuclear particles. B. A law-enforcement officer shall not use any device that employs ionizing radiation to create an image of any place, thing, or person without first obtaining a search warrant authorizing the use of the device, unless a person with legal authority consents to the search. Evidence obtained in violation of this section is not admissible in any criminal or civil proceeding. |
