HOUSE BILL NO. 1196 Offered January 19, 2012 A BILL to amend the Code of Virginia by adding a section numbered 15.2-2292.2, relating to zoning provisions for private schools and child day centers; religious institutions. ---------- Patron-- Cole ---------- Referred to Committee on Counties, Cities and Towns ----------

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 15.2-2292.2 as follows:

§15.2-2292.2. Zoning provisions for private schools and child day centers operated by religious institutions.

Zoning ordinances for all purposes shall consider (i) private schools operated by a religious institution and (ii) child day centers operated by a religious institution and exempted from licensure by §63.2-1716 as permitted uses in any zoning classification in which religious institutions are a permitted use. Localities shall not require a special use permit for the operation of such private schools or child day centers or impose conditions more restrictive than those imposed on religious institutions generally.
