Be it enacted by the General Assembly of Virginia:
1. §1. That the State Corporation Commission's Bureau of Insurance (Bureau) shall conduct an analysis of the number of covered persons, as defined in § 38.2-3438 of the Code of Virginia, in the Commonwealth who within calendar year 2017 (i) received treatment for any form of cancer; (ii) sought the approval of their health carrier, as defined in §38.2-3438 of the Code of Virginia, for cancer treatment involving use of proton radiation therapy; and (iii) received from their health carrier a denial of coverage for the proton radiation therapy. The Bureau shall further compare the health status and treatment outcomes of those covered persons who received proton radiation therapy that was covered by their health benefit plan and those covered persons who did not receive proton radiation therapy after its coverage was denied by their health carrier. The Bureau shall complete its analysis and shall report its findings to the members of the General Assembly by December 1, 2018.
