BE IT RESOLVED by the Senate of the State of Texas, 82nd | ||
Legislature, Regular Session, 2011, That Senate Rule 12.03 be | ||
suspended in part as provided by Senate Rule 12.08 to enable the | ||
conference committee appointed to resolve the differences on | ||
House Bill 2694 (continuation and functions of the Texas | ||
Commission on Environmental Quality), to consider and take | ||
action on the following matter: | ||
Senate Rule 12.03(1) is suspended to permit the committee | ||
to change text not in disagreement in proposed Section 6.03 of | ||
the bill, in amended Section 5.701(n)(1), Water Code, to read as | ||
follows: | ||
(1) Each provider of potable water or sewer utility | ||
service shall collect a regulatory assessment from each retail | ||
customer as follows: | ||
(A) A public utility as defined in Section | ||
13.002 [ |
||
regulatory assessment equal to one percent of the charge for | ||
retail water or sewer service. | ||
(B) A water supply or sewer service | ||
corporation as defined in Section 13.002 [ |
||
collect from each retail customer a regulatory assessment equal | ||
to one-half of one percent of the charge for retail water or sewer | ||
service. | ||
(C) A district as defined in Section 49.001 | ||

service to retail customers shall collect from each retail | ||
customer a regulatory assessment equal to one-half of one percent | ||
of the charge for retail water or sewer service. | ||
Explanation: This change is necessary to remove a change | ||
to the regulatory assessment collected by certain water supply or | ||
sewer service corporations. | ||
