| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article I, Texas Constitution, is amended by | ||
| adding Section 11d to read as follows: | ||
| Sec. 11d. A person taken into custody for committing a | ||
| felony shall be denied release on bail pending trial if a judge or | ||
| magistrate, following a hearing, determines that the person is not | ||
| a citizen or national of the United States and is not lawfully | ||
| present in the United States. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 7, 2017. | ||
| The ballot shall be printed to provide for voting for or against the | ||
| proposition: "The constitutional amendment denying bail to certain | ||
| persons who are unlawfully present in the United States and are | ||
| taken into custody for committing a felony." | ||
