proposing a constitutional amendment authorizing the legislature | ||
to nullify an order, rule, policy, or similar measure adopted by the | ||
executive branch of the federal government that exceeds the | ||
authority granted by the United States Constitution. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article III, Texas Constitution, is amended by | ||
adding Section 68 to read as follows: | ||
Sec. 68. The legislature without the approval of the | ||
governor may nullify an executive order, agency rule or policy, or | ||
similar measure adopted by an official or entity within the | ||
executive branch of the federal government, if the legislature by a | ||
vote of two-thirds of the membership of each house determines that | ||
the order, rule, policy, or measure exceeds the authority granted | ||
to the executive branch by the United States Constitution. An | ||
order, rule, policy, or measure nullified by the legislature has no | ||
legal effect in this state and may not be enforced or recognized as | ||
having legal effect by this state or a political subdivision of this | ||
state. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 3, 2015. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment authorizing the | ||
legislature to nullify an order, rule, policy, or similar measure | ||
adopted by an official or entity within the executive branch of the | ||
federal government that exceeds the authority granted to that | ||
branch by the United States Constitution." |
