| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article V, Texas Constitution, is amended by | ||
| adding Section 22 to read as follows: | ||
| Sec. 22. A person appointed as the police chief of a | ||
| municipality shall be subject to nonpartisan elections to determine | ||
| whether the person shall retain the office at times prescribed by | ||
| the legislature. The duties, qualifications, perquisites, and | ||
| terms of the office may be prescribed by the legislature. This | ||
| section applies only to a municipality having a population of more | ||
| than 5,000. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 3, 2015. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment providing for | ||
| retention elections for police chiefs of certain municipalities." | ||
