| undergo drug screening. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article XVI, Texas Constitution, is amended by | ||
| adding Section 74 to read as follows: | ||
| Sec. 74. Notwithstanding any other provision of this | ||
| constitution, including provisions prescribing exclusive | ||
| eligibility requirements to hold a public elective office in this | ||
| state, the legislature shall provide by general law that a | ||
| candidate for public elective office in this state must submit to a | ||
| controlled substance use screening assessment. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 5, 2013. | ||
| The ballot shall be printed to provide for voting for or against the | ||
| proposition: "The constitutional amendment mandating the | ||
| legislature to require candidates for public elective office in | ||
| this state to undergo drug screening." | ||
