| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.905, Utilities Code, is amended by | ||
| adding Subsection (l) to read as follows: | ||
| (l) As part of an electric utility's energy efficiency | ||
| incentive programs, an electric utility in conjunction with a | ||
| municipally owned water utility may design and implement a pilot | ||
| program to measure energy savings achieved as a result of the | ||
| implementation of one or more water conservation programs | ||
| administered by the water utility. The electric utility may | ||
| recover reasonable costs for the program through its energy | ||
| efficiency cost recovery factor under Subsection (b)(1) in addition | ||
| to the costs the electric utility would have otherwise recovered | ||
| through the energy efficiency cost recovery factor. | ||
| SECTION 2. The Public Utility Commission of Texas shall | ||
| adopt rules as necessary to implement Section 39.905(l), Utilities | ||
| Code, as added by this Act, not later than January 1, 2016. | ||
| SECTION 3. This Act takes effect September 1, 2015. | ||
