BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter C, Chapter 81, Health and Safety | ||
Code, is amended by adding Section 81.054 to read as follows: | ||
Sec. 81.054. COVID-19 DATA REPORTING. (a) In this section: | ||
(1) "COVID-19" means the 2019 novel coronavirus | ||
disease. | ||
(2) "Health care facility" means a hospital, | ||
freestanding emergency medical care facility, urgent care or retail | ||
clinic, outpatient clinic, birthing center, ambulatory surgical | ||
center, long-term care facility, or other facility that is licensed | ||
to provide health care services in this state. | ||
(b) Each health care facility that provides health care | ||
services to a patient diagnosed with COVID-19 shall report to the | ||
local health authority or department, in the form and manner | ||
prescribed by the executive commissioner, the number of patients | ||
treated by the facility who are diagnosed with or hospitalized for | ||
COVID-19 or for whom COVID-19 is a comorbidity contributing to the | ||
patient's death. The data must be disaggregated by: | ||
(1) age; | ||
(2) gender; | ||
(3) ethnicity; | ||
(4) race; | ||
(5) pregnancy status; and | ||
(6) vaccination status, including, if applicable, the | ||
vaccine brand and the number of weeks that have elapsed from the | ||
date of the patient's final dose of the vaccine to the date the | ||
facility first provides the services following diagnosis. | ||
(c) The executive commissioner may adopt any rules | ||
necessary to ensure health care facilities accurately and timely | ||
report the data required by Subsection (b). | ||
(d) The department shall compile, publish, and regularly | ||
update the data collected under this section on the department's | ||
Internet website, disaggregated as required by Subsection (b). | ||
(e) This section expires September 1, 2025. | ||
SECTION 2. This Act takes effect on the 91st day after the | ||
last day of the legislative session. |
