relating to certain inspections of county jails by the Commission | ||
on Jail Standards. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 511, Government Code, is amended by | ||
adding Section 511.0107 to read as follows: | ||
Sec. 511.0107. UNANNOUNCED ANNUAL INSPECTIONS OF COUNTY | ||
JAILS. (a) The commission shall annually conduct an unannounced | ||
inspection of each county jail. The inspection must evaluate: | ||
(1) the jail's treatment of and policies regarding | ||
pregnant prisoners, including the jail's compliance with: | ||
(A) the minimum requirements established under | ||
Section 511.009(a)(18); and | ||
(B) the rules and procedures established under | ||
Section 511.0104, as added by Chapter 1074 (H.B. 1651), Acts of the | ||
86th Legislature, Regular Session, 2019; and | ||
(2) the living conditions and general welfare of all | ||
prisoners. | ||
(b) The commission may conduct the inspection required | ||
under this section in conjunction with an inspection conducted | ||
under Section 511.009(a)(9) or (15). | ||
(c) The commission shall: | ||
(1) annually hold a public meeting on the commission's | ||
findings concerning the inspections conducted under this section | ||
during the preceding year; and | ||
(2) include in the annual report submitted under | ||
Section 511.015: | ||
(A) the findings described by Subdivision (1); | ||
and | ||
(B) any recommendations for legislative or other | ||
action. | ||
(d) In developing recommendations under Subsection (c)(2), | ||
the commission shall solicit and consider stakeholder input. | ||
SECTION 2. This Act takes effect January 1, 2022. |
