| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. This Act is enacted under the authority of the | ||
| legislature to pass local laws for the maintenance of public roads | ||
| and highways under Subsection (e), Section 9, Article VIII, Texas | ||
| Constitution. | ||
| SECTION 2. Section 253.008, Transportation Code, is amended | ||
| by amending Subsection (b) and adding Subsection (d) to read as | ||
| follows: | ||
| (b) Except as provided by Subsection (d), the [ |
||
| commissioners court may not require the payment of interest on an | ||
| assessment. | ||
| (d) Beginning on the second anniversary of the date of an | ||
| assessment, the Commissioners Court of Aransas County by order may | ||
| require the payment of interest on the assessment at the rate | ||
| determined under Section 304.003, Finance Code. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
