| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | ||
| is amended by adding Section 42.0505 to read as follows: | ||
| Sec. 42.0505. DENIAL OF CERTAIN APPLICATIONS FOR LICENSE | ||
| RENEWAL. (a) This section applies only to a child-care facility | ||
| licensed under this chapter that is a family residential center: | ||
| (1) operated by or under a contract with United States | ||
| Immigration and Customs Enforcement to enforce federal immigration | ||
| laws; | ||
| (2) in which each child at the center is detained with | ||
| a parent or other adult family member who remains at the center; and | ||
| (3) in which a parent or family member of a child | ||
| provides the direct care for the child except for specific | ||
| circumstances when the child is cared for directly by the center or | ||
| another adult in the custody of the center. | ||
| (b) The commission may deny an application for renewal of a | ||
| family residential center license if the license holder is under | ||
| investigation by a state agency of another state in the United | ||
| States. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
