relating to the authority of a municipality or county to regulate | ||

natural gas or propane. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 250, Local Government Code, is amended | ||
by adding Section 250.014 to read as follows: | ||
Sec. 250.014. CERTAIN REGULATIONS OF NATURAL GAS OR PROPANE | ||
APPLIANCES PROHIBITED. (a) A municipality or county may not adopt | ||
or enforce an ordinance, order, or other regulation that prohibits | ||
or restricts, directly or indirectly, the use of an appliance, | ||
system, or component that is fueled by natural gas or propane in the | ||
construction, renovation, maintenance, or alteration of a | ||
residential or commercial building. | ||
(b) This section does not prohibit a municipality or county | ||
from using an appliance, system, or component powered by any energy | ||
source on property owned by the municipality or county. | ||
SECTION 2. This Act takes effect September 1, 2023. |
